Information about Traffic Cases

If you are charged with an offense involving a motor vehicle or a motorcycle, you may be eligible to have your citation dismissed by successfully completing a driver safety course or a motorcycle operator training course. If you do not provide the court with notice of your request to take the course, you will lose the privilege.

You will not be able to take a defense driving course if you are currently taking another course or have completed a course within 12 months of your offense date. If you have a commercial driver’s license, you will not be able to complete the course. You will not be eligible for a driver safety course if you are charged with:

• Passing a school bus
• Failing to stop and give information following an accident
• Striking an unattended vehicle, fixture, or highway landscape
• Traffic offense committed in a construction or maintenance work zone while workers are present
• Speeding 95 miles per hour or more
• Speeding 25 miles per hour or more over the posted speed limit

On or before your court appearance date you may request to take an approved defensive driving course by:

• Entering a plea of guilty or no contest
• Waive a trial by jury
• Submit a Driving Safety Request Form
• A valid Texas driver’s license
• Proof of Financial Responsibility
